Retreat Participation Terms & Conditions

Rhiannon Heins is an intuitive channel, bestselling author, energy worker and spiritual teacher facilitating training in yoga, meditation, breathwork and remedial massage internationally. 

In collaboration with the Barefoot & Thriving Association, Rhiannon facilitates the "Intuitive Rebirth Practitioner Certification" retreat to train participants to heal others or themselves to become competent in intuitive energy work. 

This Retreat Participation Terms and Conditions (the "Agreement") provides for the conditions of participation in the 'Intuitive Rebirth Practitioner Certification' retreat program by Rhiannon Heins and is a legally binding document between you (the "Participant) and Rhiannon Heins (the "Retreat Organiser") upon the purchase of your ticket to this retreat program.

TERMS AND CONDITIONS

  1. Current retreat programs

Rhiannon Heins currently runs the following retreat program. Dates and locations may vary for each or any retreat from year to year, and you are advised to check the website regularly for confirmation of Rhiannon Heins events/retreat dates and locations. 

  1. Intuitive Rebirth Retreat (7 days) 
  • Seven (7) nights' accommodation at Basundari Retreat, Soulshine Retreat or a comparable retreat centre. 
  • Vegetarian breakfast and lunch on each day of the Retreat
  • Special welcome and farewell dinners.
  • Access to hotel facilities- pools, meditation areas, call-in massage, retreat cafe space.
  • Seven (7) days of Intuitive Rebirth energy-work training. 
  • Practitioner Certificate upon successful completion

                         Dates and locations

  1. Retreats are run 1-6 times a year. 
  2. Confirmed dates and locations can be accessed on the website when the program is available for purchase. (https://www.intuitiverebirth.com)
  3. The Retreat Organiser reserves the right to change venues to a venue of similar quality and location where a booked location becomes unavailable for reasons beyond the Retreat Organiser's control.
  4. For detailed information regarding inclusions, please refer to your Invoice.
  5. Participants may choose from either an early bird or standard ticket payment options. All options include full training and Retreat inclusions.

Exclusions

  1. The following services are not included or offered by the Retreat Organiser. You are responsible for the following:
  • Booking and payment for all travel and transfers to the Retreat location and venue 
  • Travel Insurance
  • Day spa extras
  1. The Retreat Organiser is not responsible for any losses you suffer for non-refundable travel, and you are advised to book any non-refundable travel AFTER your registration has been confirmed by Rhiannon Heins. 
  1. Booking and Payment 
  1. By registering for any retreat by Rhiannon Heins, you agree to all the terms of this Agreement.  

Booking fee and deposit

  1. A minimum deposit of 20% of the Retreat Fee plus a non-refundable Booking fee of USD450 is required to secure your retreat space when booking.
  2. This Booking Fee is non-refundable but transferrable to other Retreats.
  3. Payment Plan
  4. Payment plans are available to approved applicants. 
  5. Payment instalments are calculated over a 4 or 6-month period determined at the time of booking.
  6. The first payment in a payment plan constitutes the Participant's deposit and non-refundable booking fee.
  7. All payments are processed online via direct deposit, credit card, or PayPal. 
  1.   Refund Policy

Significant levels of planning, preparation and collaboration have been invested in planning the retreats by Rhiannon Heins to ensure an unforgettable and unique experience. Therefore, we have a strict refund policy.

  1. Refunds will not be available for a change of mind. 
  2. All cancellations and refund requests must be in writing by email to [email protected]. 60 days before the Retreat date. 
  3. Cancellations in the event of illness will require a medical certificate from a medical professional and will be subject to cancellation fees. 
  4. Please include a copy of your medical certificate with your cancellation request.
  5. Refund requests will be considered case by case, and approval is not guaranteed.
  6. All payments related to a retreat booking may be transferred to a different retreat by application. 
  7. If a refund is approved, the Participant will receive a full refund, less the non-refundable booking fee.
  8. Any approved refund will be refunded to the bank account the payment was made.  

Cancellation by Rhiannon Heins

  1. If the Retreat Organiser cancels the Retreat for reasons other than Force Majeure (uncontrollable circumstances as described in Clause 11 below), you will be offered an alternative date for a future retreat, or you will be provided with a full refund.  

Minimum numbers requirement

  1. Where the minimum number of participants required for the viability of the Retreat is not reached, the Retreat Organiser reserves the right to cancel the retreat event. 
  2. In the event of any cancellation by the Retreat Organiser, the following options will be available to the Participant:
  1. An alternative date for a future retreat or
  2. A full refund of payment. 



  1.   Third-party service providers
  1. You acknowledge that the Retreat Organiser contracts with a range of third parties and individuals to assist in running its retreats and events. 
  2. To the best of the Retreat Organiser's knowledge, these third parties are qualified to perform the duties they are contracted to perform. 
  3. The Retreat Organiser will not be held liable for injury, damage, loss, delay or irregularity that may occur due to the behaviour of these third parties.
  4. Any advice or information given is given in good faith, and the Retreat Organiser will not be held liable for any outcome resulting from such advice.
  1.   Medical treatment—consent
  1. As a Retreat Participant, you consent to:
  1. Receive medical assistance/treatment, which may be deemed advisable in the event of injury, accident, or illness during the Retreat.
  2. Waive any right to bring an action for loss or damage against the Retreat Organiser where assistance/treatment (provided or attempted) has accidentally worsened your condition.

    Vaccinations and Medical Clearance for Travel

  1. As a Retreat Participant, you understand and agree that:
  1. You are responsible for obtaining clearance from a qualified medical practitioner to travel and participate in this Retreat.
  2. You are responsible for ensuring you have obtained any vaccinations and medical requirements for travel to the retreat destination, including any stopovers to and from this destination.
  3. You must be physically healthy for gentle physical activity. 
  4. It is the Participant's responsibility to inform Rhiannon Heins of current pregnancies, previous or current psychiatric conditions or drug addictions, or previous traumas that could affect their participation in the Retreat. 
  5. Each Participant is responsible for sharing all necessary conditions with all retreat facilitators and fellow retreat participants during partnered activities.
  1.   Travel insurance
  1. Travel insurance is recommended; however, the decision to obtain travel insurance is the responsibility of the Participant. 
  1.   Consent to use of video and photography image
  1. You understand you may be photographed or filmed during your participation in any retreat by Rhiannon Heins.
  2. You agree to allow your photograph(s), video, or film likeness, in its original, altered or enhanced state, to be used for any legitimate purpose by Rhiannon Heins. 
  3. Legitimate purpose includes, but is not limited to, marketing purposes such as website, promotional material for public display and distribution, media release, and social media (including but not limited to Facebook, Twitter and Instagram).
  1.   Personal conduct

As a Retreat Participant, you agree to the following:

  1. To conduct yourself with personal responsibility at any Rhiannon Heins' Retreat.
  2. Should you engage in inappropriate, illegal or disruptive behaviour, you will be asked to leave the Retreat at your own cost, and no refund will be available.

Note: 

  • Inappropriate, illegal or disruptive behaviour includes but is not limited to bullying, harassment, discrimination, and unlawful, disrespectful, violent or intimidating behaviour.
  • This Clause 8 applies includes but is not limited to Rhiannon Heins' personnel and employees, the local community, other guests and participants).
  1. During any "free time," you are liable for the activities you undertake and do so knowing that the Retreat Organiser or any of its employees are not liable for your decisions.
  2. Any intake of alcohol or legal/illegal drugs is done at your own risk, and the Retreat Organiser is not held liable for consequences arising out of your actions in this regard.
  3. You, and not the Retreat Organiser, are solely responsible for any liability for repair, replacement, medical and other associated costs and any fine or penalty imposed by any relevant authority arising out of your negligence or deliberate act or omission causing damage to any equipment, premises, vehicle, public or private property or land, or injury harm or death to any person, animal domestic or wild, or flora.
  4. The Retreat Organiseriannon Heins takes no responsibility for the conduct of retreat participants. She will not be held liable for any loss or damage to a person or property caused by another retreat participant(s).

Personal items and belongings

  1. You are responsible for safeguarding and caring for your personal items and valuables. 
  2. The Retreat Organiser holds no responsibility whatsoever for any loss, theft, breakage or damage to personal items and belongings during any Retreat experience, to and from the Retreat or during any Retreat-related experience. 

Privacy of fellow participants

  1. You may take written notes during all coaching sessions; however, you are prohibited from recording presentations or private conversations without express consent from Rhiannon Heins or any other party. 
  2. You agree not to post selfies and photos taken by you with other participants without their express consent. 
  1.   Liability waiver and indemnity
  1. You agree that the Retreat Organiser is not responsible for any loss, damage, cost, expense or other liability whatsoever incurred by you arising out of:
    1. Injury, accident, or death
    2. Any delay, inconvenience, loss of enjoyment, or frustration, whether physical or mental, resulting from, but not limited to, any of the following factors:
  1. The act or omission of any party, including the Retreat Organiser or its employees.
  2. Mechanical breakdown, government actions, weather, or other factors beyond the Retreat Organiser's control.
  3. Your failure to read the information provided or follow instructions, including but not limited to obtaining sufficient travel protection and health insurance and providing correct and complete personal health and travel information.
  4. Your cancellation or change of any travel services and
  5. Your medical or health problems or physical disabilities, stated or otherwise.
  1. Release from liability

You agree that the Retreat Organiser is released from all liability arising from any negligence or fault for your death, disability, personal injury, property damage, property theft, or actions of any kind which may occur to you, including your travel to and from the Retreat, food poisoning and accommodation issues.

  1.   Disclaimer
  1. This retreat program is applied in a group setting. It is not a substitute for therapy or specialist advice tailored to your individual needs. 
  2. There is no therapeutic relationship between you and Rhiannon Heins unless you choose to work with her exclusively as a client.
  3. Anything shared in a group setting must be assumed to be private, sensitive information that must be kept confidential and not disclosed to anyone else under any circumstances.
  4. There is no guarantee that even if you do the work, you will achieve the desired results or outcomes, as this depends on a wide range of factors outside Rhiannon Heins' knowledge or control.
  5. Participants with a history of trauma or mental health issues should seek support from their GP, counsellor or therapist. If you have any concerns about your health or safety during the program, you should seek appropriately qualified professional advice immediately.
  6. You understand and agree that your participation in this program is undertaken of your own free will and desire to participate, and you agree to accept full responsibility should anything happen to you, physically, mentally or emotionally, under such circumstances.
  7. You understand and agree that you are responsible for your own success. You accept full responsibility for your decisions, actions, and results. Success is not guaranteed even if you do the work required of you. 
  8. You understand and agree that the Retreat Organiser does not provide any implied or explicit warranty as to the truth or reliability of any material or information and that any information provided to you during the Retreat and through any media. Any such material or information is not medical, legal or financial advice tailored to any particular person.  
  9. The information presented is for educational, self-reflection, self-development and entertainment purposes only, and you assume sole and full responsibility for your own decisions and actions. 
  10. You should consult suitably qualified and retained professional advisors before embarking on any business or investment venture or changing any medical or health treatment protocol.

Transport Services, activities, and excursions

  1. You agree that participating in all retreat activities, accommodation use, travel and transportation (private, hired, public, with or without a hired driver) is voluntary.
  2. You expressly agree to assume all the risk of injury and damage in participating in all activities, accommodation use, transport services, and options offered during the Retreat.

Third-party service providers

  1. You agree that the Retreat Organiser holds no responsibility for the action omissions of third parties or independent contractors, including if they modify the nature of a service or accommodation type compared to the advertised nature of the Retreat.
  2. You acknowledge that any eventuality of the same risks is not grounds for a refund or discount.
  1.   Force Majeure events (uncontrollable events)
  1. A Force Majeure event is an event outside our control that delays or hinders our ability to perform its obligations under this Agreement. 
  2. A Force Majeure event includes but is not limited to fire, flood, earthquake or similar natural disasters, riot, war, terrorism, civil strife, labour disputes or disturbances, industry-wide material or services shortages outside our reasonable control, an outbreak of pandemic disease, governmental regulations, communication, technology, or utility failures.
  3. The Retreat Organiser shall not be deemed in breach of this Agreement for the delay in performing, or failure to perform, any of its obligations under this Agreement if such delay or failure results from Force Majeure events. 
  4. Upon any Force Majeure Event, the Retreat Organiser shall notify Participants of their inability to perform or of delay in delivering and completing the Retreat. 
  5. The Retreat Organiser shall propose revisions to the Retreat schedule for completion of the Services or termination of services and this Agreement where it is determined that performance is not possible because of the duration of effect of the Force Majeure event.
  6. Where services are terminated due to a Force Majeure Event, Parties agree that both parties will make every effort to negotiate a financial arrangement to mitigate and share any loss resulting from the event.
  1.   Dispute Resolution 

You understand and agree:

  1. You will contact the Retreat Organiser immediately with any concerns so that they may be resolved quickly and effectively through friendly consultation.
  2. In the event of a dispute, you agree to the following Dispute Resolution Procedure:
  1. You must advise Rhiannon Heins in writing of the nature of the dispute, the outcome you seek and what actions you believe will settle the dispute. 
  2. You agree to meet in person or via Skype/Zoom in good faith to seek to resolve the dispute by Agreement and compromise.
  3. If an agreement cannot be reached to resolve the dispute, any party may refer the dispute for mediation to the Law Society of Western Australia (WA).
  4. Both parties must attend the mediation provided by the Law Society of WA in good faith to seek to resolve the dispute through mediation.
  1. Litigation via the court process may only be considered after a genuine attempt at mediation bought by either party is unsuccessful. 
  2. Confidentiality is paramount to both parties' personal and professional reputations and standing in their business and community.
  3. At no time will any communications or discussions be made public, including but not limited to any social media platforms or websites of either party. 
  4. Any public discussion or comments about either party will be considered defamatory, harmful or otherwise damaging and will be the subject of compensation in any mediation or litigation claim.
  1.   Governing Law 

You understand and agree:

  1. The Terms and Conditions of this Agreement are governed and construed under the laws of Western Australia, Australia. 
  2. Each party irrevocably and unconditionally submits to the exclusive jurisdiction of Western Australia.

 

By paying the required deposit, YOU, the Participant, affirm you have read and understood this Retreat Participation Agreement and voluntarily agreed to these terms.
